JUDGE OVERTURNS KENTUCKY LAW AUTHORIZING DECALOGUE DISPLAY
FRANKFORT, Kentucky (CWNews.com)
A federal judge
overturned a state law on Tuesday that had authorized the
display of the Ten Commandments on a monument erected on
the grounds of the state Capitol.
US District Judge Joseph Hood said the US Constitution
prohibits the state of Kentucky from expressing "its faith
in the Ten Commandments." Hood rejected lawmakers' claims
they were only trying to highlight the Decalogue's
significance to cultural and legal history. He said the
"purpose of this is not secular. I think it's religious."
The law had been challenged by the Kentucky chapter of the
American Civil Liberties Union, but they did not challenge
the parts of the law that encouraged school districts to
display the Ten Commandments. State officials have not yet
decided whether to appeal the decision.
